Court backs UK retirement law
A European Court adviser has ruled that the UK's stance on allowing employers to force people to retire at the age of 65 is legal.
The decision, by a senior legal adviser to the European Court of Justice, is not legally binding but gives an indication as to the overall view of the European Court, which is expected to make a final decision before Christmas.
The current law, which allows UK employers to offer staff beyond the age of 65 the chance to remain in their jobs but also to enforce retirement, is being challenged by Age Concern.
Around 260 people are currently embroiled in employment tribunals that could depend on the outcome of the European Court's decision.
The CBI argues that being able to insist on retirement at the age of 65 is an "essential management tool".Post Date: September 23rd, 2008
