New law extends rights of agency workers
Small business owners have been warned that they will have to give agency workers the same rights as permanent staff after new legislation was passed in Parliament.
The Agency Workers Regulations 2010 state that agency workers must be given the same pay, holidays and other basic conditions as directly recruited staff if they have been in the job more than 12 weeks.
However, the new rules will not obligate employers to give agency workers the same rights on additional benefits such as occupational pensions and sick pay.
"This change in the law is aimed at ensuring fairness for agency workers in relation to the permanent employees they work alongside," said business minister Pat McFadden.
The new legislation will come into force next year and companies found guilty of not giving agency workers equal treatment under the rules face pay outs of up to £5,000 and a minimum of two weeks' pay for each worker.
