Proposal to stop businesses recovering legal defence costs
Companies and business owners cleared of criminal charges could be barred from recovering defence costs under a government proposal to cut taxpayer-funded legal spending.
The ministry of justice is considering whether the public should continue to subsidise the legal fees of defendants that hire expensive lawyers rather than those on legal aid rates.
The changes could lead to businesses that are acquitted of legal charges still having to pay a fee.
Anand Doobay, a partner at City criminal defence firm Peters & Peters said that the plans would be a, "very dangerous thing to do."
Doobay also commented that there was a danger that some SMEs could go bust if prevented from reclaiming costs on acquittal.
